CALL TO ORDER

Mayor William M. Wheaton opened the regular session at 7:00 p.m.

MOMENT OF SILENCE WAS OBSERVED

ROLL CALL

Ron Gant (1), Ken Waito (3), Andy Zblewski (4), Cheryl Krause (5), George Strander (6) and Mayor William M. Wheaton.  Betty Branche (2) was absent.

            Administration: Mike Herman, City Manager;  Kevin Markovich, Director of Public Services; Kerry Helmick, Finance Director/City Clerk/City Treasurer; Eric Sanchez, Economic Development Corporation Vice President; John Tracy, Code Enforcement Officer; Daniel Strowbridge, Albion Public Safety Lieutenant and Chuck Robison, City Attorney.

MAYOR AND COUNCIL MEMBERS' COMMENTS

Comments were received from Council Members Waito and Gant.  Comments were received at Council request from City Manager Herman regarding the grass seeding at the Clinton Street road project site.

No comments were received.

VI.       CONSENT CALENDAR

A.                 Approval of Regular Session Minutes – August 18, 2008.

No comments were received.

Gant moved, Waito supported, CARRIED, to Approve the Consent Calendar as Presented.  (6-0, rcv).

VII.     ITEMS FOR INDIVIDUAL DISCUSSION

            A.         Request for 1^st Reading and Approval of Ordinance #2008-05, to Amend Sections 30-133, 30-148 and 30-168 of the Zoning Ordinance to Provide for Private Cultural/Arts Uses in Residential Areas.

                        Comments were received from Council Members Waito, Strander and Gant; Mayor Wheaton and City Manager Herman.

                        Zblewski moved, Krause supported, CARRIED, to Approve the 1^st Reading of Ordinance #2008-05, to Amend Sections 30-133, 30-148 and 30-168 of the Zoning Ordinance to Provide for Private Cultural/Arts Uses in Residential Areas.  (5-1, rcv, Waito dissenting).

            B.         Request for Approval to Sell City-Owned Property at 616 North Ann Street to Sheena Caudill for $1,500.

Comments were received from Council Member Gant and City Manager Herman.

Waito moved, Krause supported, CARRIED, to Approve Selling City-Owned Property at 616 North Ann Street to Sheena Caudill for $1,500 and to Authorize the Mayor and City Clerk Signing the City Attorney-Drafted Quit Claim Deed Upon Receipt of Payment in Full.   (6-0, rcv).

C.         Motion to Excuse Absent Council Member(s).

No comments were received.

Krause moved, Strander supported, CARRIED, to Excuse Council Member Branche.  (6-0, rcv).

VIII.   CITIZEN'S COMMENTS (Persons addressing the City Council shall limit their comments to no more than five (5) minutes.  Proper decorum is required.)

Comments were received from Council Members Gant and Waito and John LaPietra, 386 Boyer Court, Marshall.

IX.       EXECUTIVE SESSION

            The City Manager requests an Executive Session under the Open Meetings Act (Section 15.268(c), P.A. 267 of 1976, as amended) for strategy and negotiation sessions connected with the negotiation of a collective bargaining agreement when either negotiating party requests a closed hearing.       

Krause moved, Strander supported, CARRIED, to Adjourn to Executive Session.  (6-0, rcv).

            Mayor Wheaton adjourned to Executive Session.

            Mayor Wheaton re-convened the Regular Session.

            A.         Request for Approval of Letters of Understanding with POAM.

            No comments were received.

Krause moved, Strander supported, CARRIED, to Approve the Letters of Understanding with POAM as Presented.  (6-0, rcv).

X.         ADJOURNMENT

Strander moved, Krause supported, CARRIED, to Adjourn the Regular Session.  (6-0, rcv).

            Mayor Wheaton adjourned the Regular Session at 8:03 p.m.
